Draft Capital runs a scouting report, not a brokerage. These terms set out what that means in practice — what we publish, what we don't, and the rules for using this site and the newsletter.

01Agreement to these terms

These Terms & Conditions (“Terms”) govern your access to draftcapitalfinancial.com and the Draft Capital email newsletter (together, the “Service”). By visiting the site, subscribing, or reading an issue, you agree to these Terms. If you don't agree, don't use the Service.

The Service is offered to adults 18 or older. By using it you confirm you're at least 18 and legally able to enter this agreement.

02What Draft Capital is — and isn't

The Permission Line

Draft Capital ranks the board and grades the talent. It never signs your players for you. Every roster decision is yours — so do your homework before you draft.

In plain legal terms: everything we publish is editorial opinion and general financial commentary for informational and educational purposes only. None of it is investment advice.

03Risk, performance, and forward-looking statements

Investing involves risk, including the total loss of principal. Markets fall. Individual securities go to zero. Leverage, options, small-caps, digital assets, and private offerings carry risks well beyond those of a diversified public portfolio.

Past performance does not indicate or guarantee future results. Any performance figures, track records, standings, hypothetical results, or sample boards we publish are illustrative. Hypothetical and back-tested results have inherent limitations — they benefit from hindsight, do not reflect actual trading, and do not account for slippage, fees, taxes, or the emotional reality of holding a position through a drawdown.

Our content contains forward-looking statements — views about what may happen. These are opinions about an unknowable future, not promises. We undertake no obligation to update any statement after it's published, and we may change our view without notice.

You are solely responsible for your own investment decisions and for any gains or losses that result from them.

04Advertising, sponsorship, and affiliate compensation

Draft Capital is free to read because it is funded by advertising. You should assume we are being paid.

Securities offerings. Where an issue references a Regulation A, Regulation CF, or other private or exempt offering, that reference is advertising and general information — not an offer to sell or a solicitation of an offer to buy securities. Any offer is made only by the issuer, through its own offering circular or offering documents filed with or qualified by the SEC. Read those documents in full before investing. Draft Capital is not the issuer, is not a placement agent, is not a broker-dealer, and does not receive transaction-based compensation for the sale of securities. Exempt offerings are speculative, illiquid, and can result in the loss of your entire investment.

05Your subscription

Subscribing to the newsletter is free. By submitting your email address you consent to receive the Draft Capital newsletter and related service messages, including issues that contain advertising and sponsored content.

Every issue includes an unsubscribe link. One click and we stop sending. We may also remove or suspend a subscription at our discretion — for example, if an address hard-bounces repeatedly, is flagged as fraudulent, or is used to abuse the Service.

We do not guarantee a publication schedule or any particular send frequency. We may change the cadence, format, or sections of the newsletter, or stop publishing entirely, at any time.

The Service and everything in it — text, layout, graphics, the Draft Capital name and marks, the scouting grade format, and the design of this site — is owned by us or our licensors and protected by copyright and trademark law.

You may read, print, and share our content for personal, non-commercial use, and you may quote a short excerpt with clear attribution and a link back. Everything else — republication, bulk redistribution, creating derivative products, or using our content to train a machine learning model — requires our prior written permission.

08Third-party links and content

The Service links to third-party websites, offerings, and services we don't control. We provide those links for convenience and information. We are not responsible for third-party content, products, privacy practices, or conduct, and a link is not an endorsement. Once you leave our Service, that company's terms and privacy policy govern.

09No warranties

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or that the Service will be uninterrupted or error-free.

We work from sources we believe to be reliable, but we do not warrant that our content is accurate, complete, current, or free of error. Market data may be delayed or wrong. We are not liable for typographical errors or omissions.

10Limitation of liability

To the fullest extent permitted by law, Draft Capital and its owners, writers, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any investment losses, lost profits, lost opportunity, or trading losses, arising out of or relating to your use of the Service or reliance on anything we publish — even if we've been advised such damages are possible.

Where liability cannot be excluded, our total aggregate liability to you for all claims relating to the Service is limited to one hundred U.S. dollars (US$100). You acknowledge the Service is provided free of charge and that this allocation of risk is a basis of our agreement.

Some jurisdictions don't allow certain exclusions or limitations, so parts of this section may not apply to you. In that case the exclusions apply to the greatest extent permitted.

11Indemnification

You agree to indemnify and hold harmless Draft Capital and its owners, writers, contractors, and affiliates from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

12Privacy

Our handling of your information is described in our Privacy Policy, which forms part of these Terms.

13Changes to the Service and these Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also revise these Terms; when we do, we'll update the “last updated” date above. Material changes will be noted in the newsletter. Continuing to use the Service after a change means you accept the revised Terms.

14Governing law and disputes

These Terms are governed by the laws of the State of [STATE], United States, without regard to its conflict-of-laws rules. You and Draft Capital agree that any dispute arising out of or relating to the Service or these Terms will be brought exclusively in the state or federal courts located in [COUNTY, STATE], and you consent to personal jurisdiction there.

Any claim must be brought within one year after it arises, or it is permanently barred. Nothing here limits any right you have to bring a complaint to a government regulator.

15General

If any provision of these Terms is found unenforceable, the rest remain in force and the unenforceable provision is modified to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and Draft Capital regarding the Service. You may not assign these Terms; we may assign them in connection with a sale or transfer of the business.
